Elgiganten garantiservice

I'm taking this in English:

Got my Galaxy S2 c.a 5 months ago from Elgiganten. The phone didn't work so fine, CPU get overheat & battery drop sometimes.
One day I took it out of my pocket and there was a hairline crack under the glass.
I decided to call Samsung then, they said that it will be covered by warranty (material fault)

I took it to Elgiganten store 3 weeks ago. The store now want to charge me 2100 kr to fix the screen. I explained to them many times that it's not physical damage.
Elgiganten workshop checked it, and they tell me that there is no damage on the glass, but under the glass, the LCD. It clearly show that I haven't drop it or anything. But still they refused to fix it.
And then they keep asking me for reference number or RMA number from Samsung. Called Samsung many times and they said it only possible to get that if I sent it to service 3 times. They also said they have contacted Samsung and Samsung said it is not included in warranty. I mean, the first line my warranty card said is "Cover material fault".

Samsung now advice me to send the phone to them. I asked Elgiganten for that, the guy on the phone just tell me to pay 400kr to get it sent back. Now I wonder what consumer right do I have at Elgiganten? Their warranty are service, not warranty even.

What should I do now? Should I contact Konsumentverket?

Of course I do, I have my receipt and warranty card.
I mean, I have all the right to get this repaired without cost, even have some explaination.

I would just send it to Samsung. I do think you will have to pay for the shipping yourself but it shouldnt cost that much. As I dont know if samsung would be able to send a already paid ermm, shipping note or what to call it.
shouldn't be harder then to call samsung, ask them where to send it. As they told you that you should do and then just wait till you get it back.
There shouldn't be a problem to send it yourself to Samsung that is, not sending it through Elgiganten.

Welcome to Sweden I guess.

To be honest I have no idea what to do.

Almost the same thing happened to me and my SGS2 bought at SIBA. The phone was warning for overheat and couldn't really boot it properly. When it booted I had serious USB issues, it thought it was charging on / off all the time.

Took it to SIBA ofcourse and they sent it to their serviceshop. They had it for about three weeks and when I got it back they said the phone had been waterdamaged and will not be repaired due to not being a guarranty errand. I said to the personal again and again it's impossible that it is waterdamaged, "There is no point for Anovo (their serviceshop) to lie about this kind of thing and they would not gain anything from lieing" etc. Ofcourse they wouldn't listen and I had to pay 380SEK to get my phone back.

I'd say there is no easier money than that.

What I did then is I googled the problem and found out several other SGS2 owners with similiar problems around Europe got their USB circuit board replaced from guarranty. So I bought the replacementpart from Ebay for 60SEK and changed it myself. The phone has been working now without any problem for two months. A phone they would have took the the scrapyard. Unbelievable.

For your issue I hope it can be resolved.

Thank for your replies,
The phone is now at "Deltaservice" which is also a Samsung Authority Service. I don't know if it work if I just call Samsung and say that it is there so they can work on it?
This is so unfair. And edda123, you know that we have consument right right?
These shops just want money to their pocket.

Im pretty sure that Elgiganten will refund you if Samsungs own repair shop find that the damaged display is covered by the warranty.

If you send the phone to Samsungs own repair shop, and they say the defective screen is covered by the warranty, then I am pretty sure that Elgiganten will refund you for the examination/shipping.

But then they don't, since they want to blame it on physical damage to get extra payment.
I will try to contact Samsung and ask them if they can take a look at the phone there.

Considering the front glass panel isn't broken(and IIRC it's gorilla glass which means it's virtually unbreakable) but rather the LCD itself, I find it hard to believe that they're thinking you've broken it. If I were you I'd try giving Samsung a call, rather than dealing with Elgiganten. Given the way the LCD's broken I'd be surprised if this isn't covered by the warranty.

Elgiganten wont earn any money, it is Delta service who might earn something from this. You need to understand that it isn't Elgiganten who are saying that you have damaged the phone, it is Delta service (which is a Samsung approved repair shop), now Delta service wants payment since they (Delta service) claim that you have damaged the phone.

Not to mention, talked to a service guy at Elgiganten before, he said "The warranty information you got and the warranty information the workshop having here are not the same".
I was like what the hell? Then why do you guy give us the warranty information?

Most Swedish shops use Anovo in the end anyway, because they're(what I've gathered) very cheap. Unfortunately they're not the best that have happened customers here in Sweden. By calling Samsung you might be able to avoid Anovo, and then hopefully get the warranty you've paid for.

If things go worst, I should take it back and send the phone to Samsung instead right?
But on samsung page they have Delta service and MB Mobilbyrån Teleservice Stockholm so I think it would end up in Delta service anyway.

You always have the option to ask for a second (or third for that matter) opinion as long as they're from reputable sources (authorized repair shops ideally).
If such a second opinion shows the warranty should cover the damage to the phone you take that statement back to the store and ask them to refund the fee and pay for the repair if already done or edmand they repair it without charge. They can put up a fight and/or fuss about it but it's very unlikely a major store will complain as long as your statement is reliable (ie not from Roger's Phone Repair and Candy Shack).
Before embarking on any such excursion it's good to make sure you're certain of the facts and that the damage is actually not linked to any form of accident of external stress. Eventhough Samsung said the warranty should cover they based that conclusion on what you told them over the phone, ie no actual physical inspection of the phone. And let's be honest, we're all biased in those situations - some more than others..

If all else fails and you're still certain you can contact ARN and ask for a recommendation. You will still need a statement from a reputable repair shop to back your claims though.

UPDATE: After sending a mail to Samsung they replied and said:
"Its not covered by the Guarantee I am afraid. Cracks in the display are not covered unless it was there already when you bought it. "
I assume then that the service guy who replied me didn't know much about the Galaxy S2 Glass.
So I replied to them, probably will call them this evening and see how it will go.

Have also send a letter to fairtrading.se, there was 2 other person who have same problem and got fixed on such complaint cases. One even got a new phone even that his warranty is almost out.

UPDATE:
After a long long long story between lots of conversation with both Deltaservice, Elgiganten and Samsung. I called the VOC (Voice of consumer) of Samsung today. Explain the problem, they contacted Deltaservice. Then they answered me:
"No, it's a cracked screen, we cannot do anything".

Before I had an iPod Touch, sratched and only have crash on some app, Apple gave me a new one.
So solution to people: Don't buy Samsung phone.
I'm now calling my home insurence, but before that, should I contact konsumentverket?

It doesn't work that way. Warranty is a voluntary agreement on part of the reseller or manufacturer and is npt covered by Swedish consumer law. Likewise Elgiganten and Samsung may very well have different warranty plans or coverage.

However, if Samsung's own workshop finds a fault that IS covered by warranty, Elgiganten will have to refund their own charge due to the actual consumer law, Konsumentköplagen KKL. You can also demand them send the phone in under "legal warranty" rather than Samsungs/Elgiganten's own, though that's often trickier.

Unfortunately screens cracking is typically not an original fault of the product, though it may well be due to a bad choice of materials.
It's very hard to make a warranty case when the two most common reasons are sitting on the phone (which would crack the display but wouldn't crack the glass) or dropping it on pretty much anything softer than concrete or steel.

Unfortunately ARN (which is the next step) would likely side with Samsung/Elgiganten, since it's fairly obvious that the damage was done after you unpacked the phone.

A case could, as I said, be made that the phone should be able to handle that anyway, but it's very hard to do. The same could be said for a phone dying from experiencing sweat moisture in an inner pocket or from the glass cracking due to being left in the car during the depth of winter.
To my knowledge no one has succeeded yet.

And Apple is a worse-case scenario in this case, since they KNOW their glass displays are prone to cracking and even then have zero warranty on that happening.

I called my insurence and accept to get it repaired with the cost of 2150 kr
gotta pay 1500 kr for självrisk
so now my galaxy actually worth 6500 kr
